Terms and Conditions

Please take the time to read and understand our terms and conditions detailed below and agree to enter into travel service contracts with us.

  1. THE CONTRACT

The contract is made between Peruvian Ride (us) and the Client, which includes all persons named on the booking form. The person signing the booking form warrants that he/she has full authority on behalf of all persons whose names appear on it and confirms that all such persons are fully aware of and accept these conditions.

  1. PRICES & SURCHARGES

Peruvian Ride reserves the right to increase the cost of the tour taking in consideation the following: governmental action, currency fluctuations, transportation costs (including fuel costs), food increases, airport charges and scheduled airfare increases or any other increases that are beyond our control. All prices are based on U.S. dollars. If the price increases, Peruvian Ride will absorb the price increase only if the price increase is less than 4% of the total package price. If the increase is more than 4%, the customer will be charged 100% of the difference from the original price.

  1. BOOKING AND CONFIRMATION:

3.1. To confirm a booking, a deposit of 60% of the total is required.

3.2. Full payment must be received by Peruvian Ride 45 days before the tour departure date.

3.3. Booking confirmation will be provided upon receipt of the full payment.

3.4. All flights (domestic and international) must be paid in advance to secure spaces.

3.5. Receipt of payment on account; implies reservation, subject to availability of the places and services requested.

3.6. If the reservation is made 30 days or less prior to departure, full payment is due.

3.7. As soon as we receive full payment; we will send you an email re-confirming your reservation.

3.8. If full payment or the balance of payment is not paid on or before the due date, we reserve the right to treat your reservation as cancelled and make the respective charges for administrative expenses.

  1. CANCELLATION AND REFUNDS:

4.1. Cancellations must be made in writing and are subject to the following refund policy:

– 45 days or more before departure: 100% refund

– 30-44 days before departure: 50% refund

– 29 days or less before departure: No refund

– There are administrative charges that must be paid.

– Some registration fees cannot be refundable and transferable like inca trail

4.2. Peruvian Ride reserves the right to cancel a tour due to unforeseen circumstances. In such cases, a full refund will be provided.

Special Notes:

  1. Payments or deposits for flight reservations are non-refundable due to airlines.
  2. In case of postponement of the trip, an administrative fee of 20% of the trip price plus the amount already spent on non-refundable subcontracted services will be charged. The remaining amount can be used for future travel with Peruvian Ride.
  3. No refund will be made if you voluntarily abandon a trip for any reason after the trip has begun. Refunds will be at the discretion of Peruvian Ride if you are involuntarily forced to leave a trip for any reason. No refunds will be made for lodging, transportation, sightseeing, meals or services not used.
  4. It is strongly recommended that full insurance be taken out, which includes coverage, in certain circumstances, against loss of deposit or cancellation fees.
  5. CUSTOMER’S PERSONAL INFORMATION

5.1. In order for Peruvian Ride to confirm and guarantee the Customer’s travel arrangements, the Customer must provide the required travel information with full payment.

5.2. If the Customer fails to provide the required travel information 60 days or more prior to departure, an Administrative Fee will be charged.

5.3. In the event Peruvian Ride has not received the required Customer information 30 days prior to the departure of the Customer’s trip, Peruvian Ride reserves the right to treat the file as cancelled and full cancellation fees will apply. The required customer information will vary from tour to tour, and will be disclosed during the booking process. However, at a minimum, customer information includes passport number, passport expiration date, full name as it appears on the passport with which you are traveling, date of birth, place of birth, nationality and arrival information (or other documents requested by Peruvian Ride). We cannot confirm a reservation without providing the required customer information.

  1. CHANGES TO ITINERARY:

6.1. Peruvian Ride reserves the right to alter the tour itinerary due to factors such as weather, safety concerns, or unforeseen events.

6.2. Every effort will be made to provide a comparable alternative in such cases.

6.3. For any changes by the customer to the itinerary after receiving a confirmed travel invoice from Peruvian Ride, a change fee of US$40 plus any costs or charges incurred or charged by our suppliers as a result of the amendment will be charged. While every reasonable effort will be made to accommodate additional changes and requests, their availability cannot be guaranteed.

6.4. Any changes made by the Client must be made within 45 business days prior to departure of the trip; otherwise, Peruvian Ride reserves the right to accept or reject suggested amendments based on the availability of tour companies: accommodations, tour operators and transportation.

6.5 Changes to reservations made 44 business days prior to departure will not be accepted.

6.6. Any changes to the original reservation must be confirmed by the person signing the reservation form.

  1. CUSTOMER SUBSTITUTION

7.1. If any member of your party is unable to travel, it is possible to transfer the reservation to another suitable person, provided that written notice is sent at least 45 days prior to departure. An administrative fee of US$50 plus costs imposed by Peruvian Ride providers will be charged.

7.2. For the Inca Trail, any information such as dates, name and passport number is not possible after a permit has been processed. A permit is non-transferable and non-refundable. The deposit will be forfeited. Please note that we do this because we are prohibited from reselling your permit after it has been cancelled.

  1. TRAVEL INSURANCE:

8.1. Participants are strongly advised to purchase comprehensive travel insurance to cover any unforeseen circumstances, including trip cancellations, medical emergencies, death, emergency repatriation and loss of personal belongings.

Special note: In case you do not consider it necessary or do not need travel insurance; You will be responsible if any problems arise during the trip.

  1. PARTICIPANT RESPONSIBILITIES:

9.1. Participants are responsible for ensuring they have the necessary travel documents, such as passports and visas.

9.2. It is the Client’s responsibility to have a valid passport and carry it throughout the trip to show at the checkpoints required by the destination of the visit, visa permits, vaccinations and preventive medications that may be required for the duration of the Tour. Information on these matters or related items is provided in good faith but without liability on the part of Peruvian Ride.

9.3. Participants must inform Peruvian Ride of any medical conditions, pregnancy, disability or dietary restrictions before the tour.

9.4. Failure to notify Peruvian Ride may result in the Client’s trip being refused. Failure to notify Peruvian Ride of any condition resulting in cancellation will result in full cancellation fees being applied to the Client. Some trips may not be suitable for Customers due to age, mobility, disability, pregnancy or physical or mental conditions. It is the Client’s responsibility to verify before booking. Peruvian Ride may refuse to transport pregnant women for 24 weeks or customers with certain conditions. Peruvian Ride is not obligated to provide special facilities unless it has agreed to do so in writing. Peruvian Ride will make every effort to accommodate Clients’ special requests, including diet, but such requests do not form part of the Contract and Peruvian Ride is therefore not responsible for failure to provide these requests. Medical facilities vary from country to country and Peruvian Ride makes no representations and gives no warranties in relation to the standard of such treatment. Peruvian Ride is not obligated to provide special facilities unless it has agreed to do so in writing. Peruvian Ride will use its best efforts to accommodate Clients’ special requests, including diet, but such requests do not form part of the Contract and Peruvian Ride is therefore not liable for failure to provide such requests. Medical facilities vary from country to country and Peruvian Ride makes no representations and gives no warranties in relation to the standard of such treatment. Traveling with children Customers 18 years of age on the date of the first trip are considered adults. One adult over the age of 18 must accompany every 2 children under the age of 18. The ratio of adults to children traveling together must be one adult to two children and two adults to four children (17 and under). The minimum age for Clients traveling on tours is 12 years old (for Family designated tours, the minimum age is 5). All inquiries regarding children are subject to review and approval by Peruvian Ride, which reserves the right to restrict the number of travelers under the age of 18 on tours.

  1. AGE, FITNESS AND PARTICIPATION

10.1. All Clients are expected to be fit or competent prior to booking, to be fit and able to complete the itinerary of their choice. Persons over 60 years of age will be advised to obtain medical evidence of fitness to travel on their chosen itinerary.

10.2. Unaccompanied minors (under 18 years of age) cannot be accepted on tours operated by Peruvian Ride, however, older teenagers may be considered provided they are accompanied by a parent or guardian who accepts full responsibility for them.

10.3. Peruvian Ride reserves the absolute right to refuse a reservation at its discretion. Clients agree to accept the authority and decisions of Peruvian Ride’s employees, trip leaders and travel consultants while on tour with Peruvian Ride.

10.4. If, in the opinion of such person, the health or conduct of a Client before or after departure appears to jeopardize the safe, comfortable or happy progress of a tour, the Client may be excluded from all or part of the tour. In the event of illness, Peruvian Ride may make such arrangements as it deems appropriate and recover costs from the Client.

  1. HEALTH AND SAFETY:

11.1. Customers agree to accept the authority and decisions of Peruvian Ride’s employees, trip leaders and travel consultants while on tour with Peruvian Ride. If, in the opinion of such persons, the health or conduct of a client at any time before or after departure appears to jeopardize the safety, comfort or happy progress of a tour, then the client may be excluded from all or part of the tour.

11.2. In the case of health problems, Peruvian Ride may make arrangements and recover costs from the customer. If a client commits an illegal act, he/she may be excluded from the tour and Peruvian Ride will cease to have responsibility to/for them. If you are affected by a condition, medical or otherwise, that may affect other people’s enjoyment or active participation in the tour, you must inform us at the time of booking.

11.3. No refunds will be given for services not used. Clients must be in possession of a passport to show at the checkpoints where they will visit, and are responsible for obtaining a valid passport, visa if applicable, and any required vaccination certificates for the entirety of their trip. Information on these matters or related items (weather, clothing, luggage, etc.) is provided in good faith, but Peruvian Ride is not responsible for any of this information.

11.4. Peruvian Ride is not responsible for any injuries, illnesses, or accidents that may occur during the tour.

  1. PERUVIAN RIDE’S LIABILITY

12.1. Peruvian Ride organizes; by order and on behalf of our travelers with their names; transportation, accommodation and other required tourist services, therefore we are not responsible in case of accidents, loss of personal belongings during the subcontracting of services such as: during the tour guide services, in the bus, in the hotels, in the restaurants, during the treks, in the camp, etc., delays or interferences with the tour, due to the strength of the main reasons for which we have no direct responsibility.

12.2. Peruvian Ride is not responsible for illness, maternity, physical or mental impairments, which may endanger the health or integrity of the traveler or third parties during the tour. We will not assume any claim or reimbursement due to the reasons mentioned above.

Peruvian Ride will not pay compensation if it is forced to cancel or change its tour due to war, threat of war, riots, civil strife, industrial disputes, natural disasters, fire or adverse weather conditions, epidemics or health, technical or maintenance hazards, problems with transportation, closed or congested airports or ports, changes imposed by the rescheduling or cancellation of airline flights, alteration of airline or aircraft types, or similar events beyond Peruvian Ride’s control.

12.3. Peruvian Ride will not accept responsibility for changes in flight schedule or departure airport, as this is the responsibility of the airline. However, we will endeavor to minimize their effect on your trip.

12.3. We cannot accept liability for delays to any of your flights, whether the cancellation or delay is caused by adverse weather conditions, rescheduling by the airline, airport authority and/or action by air traffic controllers, mechanical breakdown or industrial action. When extended flight delays result in the loss of vacation time, hotels or suppliers do not issue refunds. When lengthy flight delays result in lost vacation time, hotels or suppliers do not provide refunds. Similarly, airlines do not offer compensation for flight delays. However, at their discretion, carriers will endeavor to reduce the inconvenience of any delays by providing meals and accommodations, as appropriate for the time of day or night (depending on local availability). If you incur payments for such services in the event of delay.

12.4. Peruvian Ride will not accept responsibility for payment unless we have given our prior consent. We request to be informed prior to the agreement of our services, about any limitation of this nature, in order to recommend special services that contemplate the existing impediments.

  1. FORCE MAJEURE:

13.1. Peruvian Ride is not liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of terrorism, and government actions.

  1. FLIGHT RESERVATIONS

Peruvian Ride will make every effort to ensure that all flight prices are correct at the time they are quoted. Airlines reserve the right to modify or withdraw fares without prior notice. Once a deposit is paid on an airfare, a reservation is guaranteed to be held for you, IT DOES NOT GUARANTEE the fare. The fare can only be guaranteed when the flight reservation has been paid in full and a ticket has been issued. The client is subject to the conditions and restrictions of the air ticket. The flight schedules offered by Peruvian Ride are for general guidance only and are subject to change. Updated flight times will be displayed on the tickets. The Customer must check the tickets very carefully immediately after receiving the latest schedules

  1. COMPLAINTS:

15.1. If the Client has a complaint during the tour, it should be informed as soon as possible to the tour leader or other Peruvian Ride representative at the time so Peruvian Ride can make every effort to rectify the situation. Only by informing Peruvian Ride of any problems will there be an opportunity to make things right. Complaining to Peruvian Ride when a problem arises during your trip will allow us to remedy the situation or facilitate compensation. If the problem remains unresolved, a written complaint must be made to Peruvian Ride within 28 days of the end of the vacation.   1. PHOTOGRAPHY AND MARKETING:

16.1. Peruvian Ride reserves the right to use photographs and videos taken during the tour for marketing and promotional purposes, unless otherwise specified by participants.

  1. FINANCIAL SECURITY

Peruvian Ride is a tour company registered in public records and with RUC No. 20604222517. We are a local tour operator, under the name of Peruvian Ride SRL; we do not own any vehicles, lodging, hotel, restaurant, etc. Instead, we carefully select the local operators in Cusco, Lima, Arequipa, Puno, Ica, Amazonas, Trujillo, etc. and the facilities we want to work with, and who we can trust, based on our 10 years of experience.

  1. GOVERNING LAW:

18.1. These terms and conditions are governed by the laws of Peru, and any disputes will be subject to the exclusive jurisdiction of the courts in Peru.

  1. PRIVACY POLICY

The company will use the personal information you provide to us to make all travel arrangements. As such, we will need to pass it on to our suppliers and carriers so that we can enable the operations of the services you have requested. However, we will strive to protect your information and use it for official purposes only for which it is extremely necessary. I have taken a lot of time to read the Terms and Conditions of Booking. I have fully understood all the clauses and give my full consent to all of them.

By booking a tour with Peruvian Ride, participants acknowledge that they have read, understood, and agree to abide by these terms and conditions.
